Emtel Limited one of of the the Group’s subsidiary has lodged a a a a a a a a a a a a claim for for damages in in in in excess of of Rs 1 billion (USD 32m) (plus interest and and and cost) against the the Information & Communication Communication Technologies Authority Mauritius Telecom Telecom Ltd Ltd Ministry of of of Technology Telecommunications and and and and Innovations and and and and Cellplus Mobile Communications Ltd Ltd for for losses incurred as a a a a a a a a a a a a a a a a a a a a a a result of of of of of inter alia failure by by the the the authorities to to ensure a a a a a a a a a a a a a a a a a a a a a a level of of of of of playing field and and and and unfair competitive practices Judgment was was given by by the the the the the Supreme Court in in in in favour of of of of Emtel Emtel Limited Limited on the the the the the 9 9 9 August 2017 and and and a a a a a a a a a a a a a a a a a a a a a a a a total amount of of of of Rs 554 139 900 with costs and and interests at at the the the the the legal rate was was was awarded to to Emtel Emtel Limited Limited The The Defendants have lodged their respective appeals before the the the Supreme Court Court (Court of Civil Appeal) The The Appeal Appeal was was been fixed for for merits in in in in November 2019 and will be be continued in in 2020 On the the other hand Emtel Emtel Limited has received a a a a a a a a a a a a a a a a a counter claim from from Data Communications Ltd for for Euros 1 5
million for for allegedly failing to supply an an an uninterrupted data service in in in in in in respect of of an an an International Private Line leased from from Emtel Emtel Limited The case is not yet in in in in in shape for trial with DCL in in in in in the process of of liquidation At this stage the the the Board of Directors does not believe that Emtel Limited will be be required by by the the the Court to to settle the the the amount claimed by Data Communications Ltd RELATED PARTY TRANSACTIONS
